VENUplus Inc. (“VENUplus,” “VENU+,” “We,” “Our,” or “Us”) takes your privacy very seriously. This Privacy Policy (the “Policy”) applies to all VENU+ websites, apps, products, and services, including those listed below (collectively, the “Services”). It also describes the rights you may have regarding your Personal Information pursuant to applicable privacy laws. Please see the U.S. State Privacy Rights section of this Privacy Policy for more information about these rights and how to exercise them. By accessing and using the Services, you accept this Privacy Policy and our Terms of Use, which incorporate the Privacy Policy. If you do not agree, do not use the Services.

For purposes of EU and UK data protection laws, the data controller for the Services is VENUplus Inc., 200 W. Sand Lake Road, Suite 800, Orlando, Florida 32809.

For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

1. NOTICE AT COLLECTION: PERSONAL INFORMATION WE COLLECT

The categories of Personal Information we may have collected during the 12 months preceding the date of this Policy, and will continue to collect, include the following:

Some of the information described above may be considered “sensitive” under the laws of certain jurisdictions (including driver’s license number or passport number, payment information, account login credentials, and geolocation information) (“Sensitive Information”). Whether information is Sensitive Information will depend on the laws of your jurisdiction

2. NOTICE AT COLLECTION: USES OF INFORMATION

Your Personal Information may be used any of the following ways:

  • Providing the products and services you request
  • Communicating with you regarding our services or your request for information, to conduct business with you (or with your employer, in the context of business-to-business relationships), or to otherwise respond to a request that you have made
  • Enforcing our rights arising from any contracts entered into between you and us
  • Protecting our rights or property or our safety, our members, or others
  • Complying with any court order, legal process, or respond to any governmental or regulatory request
  • Transferring information in the event of a merger, transfer of assets or other organizational restructuring
  • Monitoring and evaluating our Services and identifying where we should make changes or expand services
  • Marketing products and services that may be of interest to you
  • Displaying targeted ads about goods and services that may be of interest to you
  • Providing customer service and support, and for quality control or training purposes

We use Sensitive Information for necessary or reasonably expected purposes – specifically, to provide you with our Services (i.e., to prevent fraud and theft, to verify your age or identity, to fulfill purchases, to allow account logins, and to track the precise location of equipment that you rent from us to prevent use outside of permitted areas). We also use Sensitive Information as authorized by law.

3. Notice at Collection: Personal Information Sold or Shared to Third Parties in the Preceding 12 Months

We sell or share the following Personal Information with third-party partners such as advertising networks, social networks, and our affiliates which may not share common branding so that we and/or our third-party partners can deliver targeted ads and other tailored communications to you: Personal Identifiers; Commercial Information; Internet or other electronic activity information; and Inferences.

If you would like to opt-out of the sale or sharing of any of the information as above, please submit an opt-out request via our Data Request Form, or by calling us at 800-385-4973.

4. Notice at Collection: Retention Periods

We retain the categories of Personal Information we collect for the length of time necessary to provide our services and to comply with legal obligations or to protect our legal rights.

5. SOURCES OF PERSONAL INFORMATION

We collect and obtain Personal Information from:

  • You. We collect Personal Information that you voluntarily provide to us, for example when you communicate with us via email or other channels, when you visit our Services, including by submitting orders, renting our equipment, or inquiring about our services and offerings; participate in our surveys; or when you otherwise voluntarily provide information to us.
  • Service Providers. We may use third-party service providers or other third-party organizations helping to support our mission that may collect, store, or process your Personal Information on our behalf, such as to complete your request (e.g. completing a transaction or to outsource one or more of the functions described above).
  • Affiliates. We may get information about you from other companies that are a part of the Z Capital Group, LLC (“ZCG”) family of brands.
  • Advertising and Marketing Partners. We work with companies that help us deliver, measure, and analyze the effectiveness of our ads. These companies collect information about you when you interact with ads on our platforms and on the websites where our ads are displayed.
  • Cookies and Similar Technologies. We use tracking tools like browser cookies and web beacons to collect information from and about you. We collect information when you interact with our websites, our ads, and our emails that we or our vendors send to you. We collect information about users over time and across devices when you use this website. We may have other parties collect Personal Information this way. 6. Sharing of Personal Information

We may share your Personal Information with the following categories of entities:

  • Affiliates. We share each of the above categories of Personal Information within the ZCG family of brands, including with our affiliate companies.
  • Service Providers. We share each of the above categories of Personal Information with companies and individuals that provide services on our behalf, help us operate our Services, or help us to provide the services that you request. For example, we share your payment and financial information with third party service providers for purposes of processing your payment for products and services that you purchase or rent from us.
  • Third parties who may use your Personal Information for their own independent purposes in accordance with their own privacy policies. For example, we share Personal Information with agencies, advertisers, our affiliates and other third parties who provide products/services that may be of interest to you or who serve ads. We work with third-party advertising networks, social networks, data brokers, and other companies to serve ads when you visit our Services. These companies may use information about your visits to our Services and other websites in order to provide advertisements about goods and services of interest to you.   • Third party analytics companies that help us to monitor traffic on the Services and learn and analyze how users are navigating and using our Services
  • Law enforcement or legal authorities, in response to lawfully served process or subpoena. Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information. We will disclose information upon receipt of a court order, subpoena, warrant, or other legal process to the extent necessary to meet legal, national security, public interest, or law enforcement obligations. We fully cooperate with law enforcement agencies in identifying those who use the Services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
  • Successor company or companies in the event that we cease operations for any reason. If we enter into an agreement to be purchased by another company or to merge with another company, we may share Personal Information with that company. We will require that such purchasers continue to comply with the provisions as outlined in this Privacy Policy.

7. OTHER MARKETING COMMUNICATIONS

You can opt out of receiving our marketing emails and text messages. To stop receiving our marketing emails, you can follow the “unsubscribe” instructions in any marketing email message you get from us. Even if you opt out of getting marketing emails, we will still send you transactional messages. These include responses to your questions. You can also opt out of our marketing text messages by replying “STOP”.

8. U.S. State Privacy Rights

You have the following rights, where provided under applicable state law, regarding your Personal Information (each of which are subject to various exceptions and limitations):

Your Right To Request Disclosure of Information We Collect and Share About You

We are committed to ensuring that you know what Personal Information we collect. To that end, you can ask us for any or all of following types of information regarding the Personal Information we have collected about you:

  • Specific pieces of Personal Information we have collected about you;
  • Categories of Personal Information we have collected about you;
  • Categories of sources from which such Personal Information was collected;
  • Categories of Personal Information that the business sold or disclosed for a business purpose about the consumer;
  • Categories of third parties to whom the Personal Information was sold or disclosed for a business purpose; and
  • The business or commercial purpose for collecting or selling your Personal Information.

Your Right To Request Correction of Personal Information We Have Collected About You

You have the right to request that we correct inaccurate Personal Information collected from you, subject to certain exceptions allowed under applicable law. We will accept, review, and consider any documentation that you provide in connection with your right to correct, provided you make a good-faith effort to provide us with all relevant information available at the time of the request.

Your Right To Request Deletion of Personal Information We Have Collected About You 

Upon your request, we will delete the Personal Information we have collected about you, except for situations where applicable law authorizes us to retain specific information, including when it is necessary for us to provide you with a good or service that you requested; perform a contract we entered into with you; maintain the functionality or security of our systems; or comply with or exercise rights provided by the law.  The law also permits us to retain specific information for our exclusively internal use, but only in ways that are compatible with the context in which you provided the information to us or that are reasonably aligned with your expectations based on your relationship with us.  We will act on your deletion request within the timeframes set forth below.

Your Right to Ask Us Not to Sell or Share Personal Information We Have Collected About You

You have the right to opt-out of the “sale” of your Personal Information (defined very broadly to include situations where we provide Personal Information to partners who provide advertising services to us) and the “sharing” of Personal Information in connection with the display of targeted advertising across third party websites. You can direct us not to sell or share your Personal Information by submitting an opt-out request via our Data Request Form, or by contacting us at 800-385-4973. We will act on your request within the timeframes set forth below.

We also honor the Global Privacy Control, a browser-based opt-out signal. We do not respond to other browser-based signals that do not meet applicable state law requirements, which may include older Do Not Track signals.

Your Right to Appeal

You have a right to appeal decisions concerning your ability to exercise your consumer rights.

Exercising Your Rights and How We Will Respond

To exercise any of the rights above, or to ask a question, you may contact us at 800-385-4973, fill out our Data Request Form, or use the contact details set out at the end of this Policy.

For requests for access, correction or deletion, we will first acknowledge receipt of your request within 10 business days of receipt of your request.  We provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances.  If we expect your request is going to take us longer than normal to fulfill, we will let you know.

For requests to stop the sale or sharing of your Personal Information, we will comply no later than 15 business days after receipt of your request.

We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations.  In some cases, the law may allow us to refuse to act on certain requests.  When this is the case, we will endeavor to provide you with an explanation as to why.

Verification of Identity – Access, Correction or Deletion Requests

We will ask you for identifying information and attempt to match it to information that we maintain about you.

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to your request.  We will notify you to explain the basis of the denial.

Ensuring Veracity of Requests

If we have a good-faith, reasonable belief that a request to delete Personal Information is fraudulent, we may deny the request.  Should this occur, we will inform you and explain why we believe the request is fraudulent.

Authorized Agents

You may designate an agent to submit requests on your behalf.

If you would like to designate an agent to act on your behalf, you and the agent will be required to provide us with proof of the agent’s identity and proof that you gave the agent signed permission to submit a request on your behalf.  Additionally, you will be required to verify your identity by providing us with certain Personal Information as described above or provide us with written confirmation that you have authorized the agent to act on your behalf.

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney.  Any such requests will be processed in accordance with applicable law pertaining to powers of attorney.

Requests for Household Information

There may be some types of Personal Information that can be associated with a household (a group of people living together in a single dwelling).  Requests for access or deletion of household Personal Information must be made by each member of the household.  We will verify the identity of each member of the household using the verification criteria explained above and will also verify that each household member is currently a member of the household.

Non-Discrimination

We will not discriminate against you for exercising any of the rights described herein.

Notice of Financial Incentive

From time to time, we may offer financial incentives in connection with the collection or use of Personal Information.  The material terms of the financial incentive will generally be presented to you at the time you sign up. You may withdraw from any financial incentive at any time by emailing us at privacy@venuplus.com.

California Shine the Light

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about certain categories of Personal Information a business has disclosed to third parties for direct marketing purposes in the preceding calendar year.  To submit a Shine the Light request, please send an email with the subject line “California Shine the Light Request” to privacy@venuplus.com.

9. Disclosures for EU AND UK Residents

Legal Basis for Processing. The laws of some jurisdictions, such as the European Union and the United Kingdom, require data controllers to have a lawful basis for each use or disclosure of Personal Information. To the extent those laws apply, our legal basis for collecting and using the Personal Information described above will depend on the personal data concerned and the specific context in which we collect it. Our lawful bases include where: (a) you have given consent to the processing for one or more specific purposes, either to us or to our service providers, partners, or customers; (b) processing is necessary for the performance of a contract with you (e.g. to fulfill your request or provide the products and services that you have requested); (c) processing is necessary for compliance with a legal obligation; or (d) processing is necessary for the purposes of the legitimate interests pursued by us or a third party, and your interests and fundamental rights and freedoms do not override those interests. Where we rely on your consent to process your Personal Information, you have the right to withdraw or decline consent at any time. Where we rely on our legitimate interests to process your Personal Information, you have the right to object.

Privacy Rights. Depending on the applicable law, which may be determined by your country, region or state of residency, you may be able to exercise one or more of the following rights relating to our processing of your Personal Information.

  • Right to Access. You have the right to ask us for confirmation on whether we are processing your Personal Information, and ask us for copies of your Personal Information.
  • Right to Correct. You have the right to ask us to rectify Personal Information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • Right to Delete. You have the right to ask us to erase your Personal Information in certain circumstances. We may retain backup copies of your information, including to assist with any legal obligations, resolve disputes, and enforce our agreements. We will retain your information for as long as necessary to fulfill the purposes of processing described in this Notice.
  • Right to Object to Processing. You have the right to request that we cease processing your Personal Information in certain circumstances.
  • Right to Restrict Processing. You may have the right to request that we restrict processing of your Personal Information in certain circumstances (for example, where you believe that the Personal Information we hold about you is not accurate or lawfully held).
  • Right to Data Portability. You have the right to ask that we transfer the Personal Information you gave us to another organization, or to you, in certain circumstances.
  • Right to Lodge a Complaint with a Supervisory Authority. You have the right to complain to the data protection authority in the country in which you reside, work, or believe an infringement of data protection laws has taken place. To exercise any of these rights, please contact privacy@venuplus.com. We will respond to your request within 30 days. We may require additional information from you to allow us to confirm your identity. Please note that we store information as necessary to fulfill the purposes for which it was collected, and may continue to retain and use the information even after a data subject request for purposes of our legitimate interests, including to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements

We store personal data for different periods of time consistent with the purposes for which they were originally collected, as subsequently further authorized, or when required or allowed under applicable law.

We do not subject data subjects to decisions that have legal effects on them due solely to automated processing of personal data.

10. INTERNATIONAL TRANSFER

VENU+ is a global company and has its headquarters in the United States. We may transfer your information to our affiliates, service providers, and other third parties located outside of your country of residence, including in the United States. This is necessary to provide our Services and for the purposes outlined in this Privacy Policy.  Data privacy laws vary from country to country and may not be equivalent to, or as protective as, the laws in your home country.  If you prefer not to have your Personal Information transferred to the United States, or one of its territories, do not use the Services.  Otherwise, by using these Services, or providing any information, you consent to the transfer of Personal Information to the United States and other destinations outside your home country.

11. SECURITY

We are committed to maintaining your confidence and trust and take reasonable steps to help protect the Personal Information you provide to us. However, no transmission or electronic storage of information is guaranteed to be secure. We therefore urge you to always use caution when transmitting information over the Internet.

12. MINORS

Our Services are intended for a general audience,  and we do not knowingly collect Personal Information from individuals under 16. Please also note, for purposes of California law, we do not knowingly sell or share the Personal Information of minors under 16 years of age.

If we discover that we have collected Personal Information from an individual under 16 years of age, we will take appropriate steps to remove or disable that Personal Information from our systems. If you believe that we have inadvertently collected Personal Information from a minor, please contact us at privacy@venuplus.com.

13. THIRD PARTY WEBSITES

Our Services may contain links to other third-party websites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these websites. Accordingly, we recommend that you review the privacy policies posted on any website that you may access through our Services.

14. CHANGES AND UPDATES

We may revise this Privacy Policy from time to time. We will post any changes on this page and update the date at the top, so be sure to check back periodically to stay aware of any modifications. Your continued use of the Services after changes have been posted will constitute your acceptance of this Privacy Policy and any changes.
